Terms of Service

These terms govern access to and use of the Retalk website, dashboard, desktop app, billing, and related services.

1. Eligibility and acceptance

You must be at least 18 years old and capable of forming a binding contract to use Retalk. If you use the service for a company or other organization, you represent that you have authority to bind that entity to these terms. By accessing or using Retalk, you confirm that you have read and agree to these terms and our Privacy Policy.

2. Accounts and registration

Some features require an account. You must provide accurate, current, and complete information, keep credentials secure, and promptly notify us if you believe your account has been accessed without authorization. You are responsible for activity that occurs through your account.

3. Privacy and service communications

We process personal information as described in our Privacy Policy. By using Retalk, you acknowledge that we may collect and use account, usage, device, and billing information to operate, secure, support, and improve the service. We may send transactional messages about your account, billing, service updates, legal notices, and support requests.

4. Service scope and availability

Retalk provides real-time voice translation for meetings and calls, including the website, dashboard, desktop app, virtual audio device workflows, billing, and related support. We may change, add, suspend, or discontinue features at any time. We try to describe the service accurately, but previews, pricing displays, provider behavior, and availability may change or contain errors.

5. Payments and refunds

Some services require payment. Subscriptions are handled through third-party payment processors. Usage is metered by translated session minutes. Unless required by law or stated otherwise at checkout, fees are non-refundable after the related paid period or usage has begun.

6. License and intellectual property

Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use Retalk for internal, personal, or business use. The service, software, interface, branding, documentation, and underlying technology are owned by us or our licensors. You may not copy, resell, reverse engineer, remove proprietary notices, scrape the service, or use the service to build competing products unless we explicitly allow it in writing.

7. Audio, captions, and transcripts

You retain the rights you already have in content you process with Retalk. Audio is translated in real time and is not stored by Retalk. Transcripts remain on your device unless you choose to export or share them outside the app.

8. Prohibited use

You may not use Retalk for illegal, harmful, exploitative, infringing, deceptive, harassing, hateful, violent, fraudulent, malware, or privacy-invasive activity. You may not bypass usage limits, defeat security controls, exploit bugs, use another user's credentials, or disrupt the service or other users.

9. Third-party services

Retalk relies on third-party model providers, identity providers, hosting providers, analytics services, and payment processors. Your use of those integrations may be subject to separate third-party terms, policies, technical limits, output restrictions, and availability. We are not responsible for third-party services that we do not control.

10. Enforcement and termination

We may investigate violations and take appropriate action, including refusing transactions, limiting features, suspending access, or terminating accounts. We may act immediately where we detect abnormal, abusive, unlawful, or risky behavior. If your account is suspended or terminated for cause, you remain responsible for fees already incurred and obligations that accrued before termination.

11. Disclaimers and liability

Retalk is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities arising from use of the service.

12. Indemnification

You agree to defend, indemnify, and hold harmless Retalk, its operators, affiliates, personnel, contractors, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses arising out of your content, violation of these terms, misuse of personal data, or infringement of third-party rights.

13. Force majeure and severability

Neither party is liable for delay or failure to perform caused by events beyond reasonable control, including natural disasters, war, civil unrest, labor disputes, internet outages, infrastructure failures, provider outages, or government actions. If any provision is found unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.

14. Changes to these terms

We may update these terms from time to time. When we do, we will post the revised version on this page and update the effective date. Your continued use of Retalk after updated terms take effect constitutes acceptance of the revised terms.
